They would have to be gambling on a NY Repuke governor in the near future for #2 to hold true.

More likely they are just betting on getting one MAGAt/moron out of twelve on the jury. Hung jury. Retrial. Rinse and repeat, ad nauseam. As long as they can pay their lawyers (like perhaps the Trump Org offers to pay them, for real), they can draw it out until the prosecutors give up because of the waste of resources.
