SCOTUS as well as the lower courts. Remember Biden has a commission looking at the federal courts that has a 6 month window to report and they are well into that timeframe.

Not too long ago, I read or heard that even though FDR's court packing plan failed, SCOTUS got the message and never again overturned a New Deal law. I think Roberts will follow this precedent.
