I think the city and state just never felt it would be worth the years and years of trials and appeals and legal hassles that Trump would have forced them to go through to prove he did bad shit. Probably cheaper to just let him commit tax fraud and other things than to prosecute him.
Trump's pretty fucking stupid, but he seems to pretty smart about how to commit fraud and how to hide - I bet his books are twisted, labyrinthine, nested and subnested and subsubnested schemes that are very difficult to untangle.
