In almost every state lying to the police is a misdemeanor. It only becomes a felony if you lie to them under oath. In this case it is not relevant because he is not talking to anyone period.

And generally when talking to the police you can only be charged with lying if it is about 1) your identity, 2) filing a false police report or crime and 3) speaking under oath. If it is outside those three you can't be successfully prosecuted. But in this case none of it applies when you don't speak to them.
