37. That isn't correct; They are talking about the DOJ making settlements,so the cases don't go to court

One reason may be that the DOJ doesn't want politically to be put in the position of having to argue as the defendant. They want to make the settlements lucrative enough that the attorneys accept the amount for their clients to avoid any trials.
