39. O'Connor wasn't a federal judge (she was on the AZ Supreme Court)

Kagan wasn't (she had clerked for Thurgood Marshall, and was Solicitor General of the US, and was nominated for DC Appeals). Others had very short stints as federal judges before being appointed to the Supreme Court. Marshall served for a bit under 4 years, for example.
