It is not a broadcast operation. It is distributed via cable and satellite.

I do see that a local Fox Broadcasting affiliate, DC's channel 5, carries Fox News programming on Sunday morning.

Once again, the message, apparently offical, Fox News is not a broadcast operation. It is thus not subject to FCC regulation.
