They often do.
They won't charge Abbott with kidnapping because this being done via Executive Order by the State of Texas, not Greg Abbott.

Lots of times states violate immigration law. The fed government sues the state, they don't arrest the governor. Governors and presidents write illegal executive orders from time to time. I have never heard of anyone being arrested because of an Executive Order.
