That doesn't excuse the fact that it's unamerican, I bet you like the terrorist watch list also, where your name is put on a list by some faceless govt. entity, where your not even informed that your name is on the list, where you have no recourse to get your name off that list, where you are not entitled to face your accuser, call witness's to testify on your behalf, where your guilty, period, that's as bad as the patriot act. Ted Kennedy was on the watch list and the no fly list, and he didn't even know it until he tried to board an aircraft.
Does that sound like the kind of America you want? The Patriot Act has so expanded the powers of the Fed. Govt. to spy on it's own citizens, secret courts, held in detention w/o charges, warrantless wiretapping. That sound like the America you want?
That's not the America I grew up in and your endorsement of a Bushco POS legislation is, IMHO, wrong.
BTW, please explain what's outdated about the 2A.
