In selecting LaSalle, Hochul reneged. A letter I signed along with 45 other New York law professors details some of LaSalles shortcomings. Several decisions he joined suggest his hostility to labor, reproductive rights, and due process. And according to a statistical analysis conducted by the new legal data startup Scrutinize, LaSalle is a conservative outlier on an already conservative court among the 25% most conservative judges on the Second Department. He is also a former prosecutor, when the court counts three former prosecutors already and not a single judge from a defense background

An excerpt from that letter referenced above:
The decision is shocking. We recognize the need to protect the First Amendment right to speak and assemble. This might have justified court review of sensitive documents, like a list of funders. But it provides no justification for concluding that the CPCs promotional materials or funders were not relevant to an investigation of the CPCs fraudulent activities. After all, it was precisely through its promotional literature, which someone paid for, that the CPC engaged in harmful conduct.
This opinion suggests to us that Justice LaSalle does not understand the severity of the threat to womens rights posed by anti-abortion activists and their funders. With the Supreme Courts reversal of Roe last term, it is imperative that New Yorks judges appreciate the importance of the right to choose and the many different fraudulent subterfuges anti-choice activists deploy.
