(25,213 posts)No, a court does not have to decide to take a child from a parent. Children can be taken by the government in several different ways.
1) Arrest
2) Baker Act
3) DCS
When my youngest was 13, the local police showed up at my house on a Sunday evening and Baker Acted him. Why? Because he and a group of friends were goofing around texting memes to each other. He sent one that had to do with self-harm. One of his friends took it seriously and called the police without running it by her parents, my son, or his parents (me).
Despite my son telling the cops he was not suicidal, they took him anyway.
A good friend is a psychiatric nurse and was able to tell me where he was most likely taken. I was told to prepare for him to be held for three days before being released, but fortunately a psychiatrist with a head on her shoulders released him within 24 hours.
The authorities can take kids out of school and not inform their parents. It's insane!!!
Lots of tears, anxiety for years, and $1,000 to the "care facility" for the less than a 24 hour stay was the result.
You're damn right the government can take your kid with no warning.
