If she resigned in December, then Newsom would have named a replacement, who would have been sworn in. That replacement wouldnt have been seated on any committees until January 3 , when the rest of the senate convened for the start of the new congress, and voted on the rules and committee assignments. The replacement might not have been assigned to the Judiciary Committee, someone more senior might have been appointed.
The point is, if the replacement had been in office before January 3 when the new congress convened, the rules and committee assignments would have approved by unanimous consent (which they were), and the Republicans couldnt block filling the Judiciary committee seat.
