Lawrence O'Donnell nailed it last night (Dominion) [View all]

I'd heard a lot of this in bits and pieces before, but a lot that contradicted it, especially with the moaning and groaning about no trial. But he stated it so well and so firmly that he's the one I trust on this. Did he get it wrong anywhere?

Note - I didn't record it or anything. I'm quoting to the best of my memory, which is not particularly good.

There never would have been an apology from Fox. In a civil suit it's all about money. The only judgement the jury can render is a dollar amount. They could not have required an apology.

There are rarely surprises in a defamation trial. We heard almost all of what there was to hear in the depositions.

We would never have seen Carlson or Hannity or anyone else answering questions under oath because the judge prohibited cameras. We would have only gotten people like me reading from transcripts.

If it went to trial there is a strong liklihood that the amount of damages would have been reduced by the court, after years of litigation and appeals.

So it looks like the laments about no trial were not based on much.
