They would have still had to make the go-forward decision months before. Smith would not have agreed to be a "maybe" specal council.

So I doubt they were thinking "if he decides, we will be ready". It's possible it was coincidence, I'll give you that. But they weren't going to back out if he didn't decide to announce.
