He likely has no more access to the kind of sensitive information that could put the US into problems. He certainly can continue to run his mouth and stoke violence from his idiot followers, but that would likely happen if he was in jail as well.

I think the DOJ wants him to keep giving them more grounds to prosecute so they are letting him talk.
