Governor Otter was so sure that the ACA would be ruled unconstitutional by the Supreme Court that he told the Republican leaders of the state legislature not to bother with setting up an insurance exchange because it wouldn't be needed.
After the Supreme Court ruled that the ACA was indeed constitutional at the end of their session, Otter told the legislature's Republican leaders to hold off on setting up an insurance exchange because he was sure that Romney would be elected President, and that he would preclude enacting the full provisions of the ACA into law while working to repeal the ones that were already active.
Now Governor Otter and the Republican leaders of the state legislature are waiting to see if they should call an emergency session of the legislature to set up an exchange, or if they should just wait until January when they reconvene.
