Where does that statute address a conflict with the president? The office of the president has nothing to do with "conflict of interest."
Merrick Garland did not have to appoint Jack Smith because of a conflict of interest and Merrick Garland did not have to appoint special counsels to investigate Hunter Biden and Joe Biden because of a conflict of interest, that was Merrick Garland's rules.
Section b, of your cut and paste. the Pontius Pilate rule, may apply but not the rest of the statute.
If Chris Christie or Nikki Haley murder someone DOJ is not required to appoint a special counsel.
Hunter Biden isn't president either last I checked, neither is Trump.
