Tipped employees aren't exempt from minimum wage requirements. Their employer is required to ensure they earn full standard minimum wage. If they happen to be on the breakfast shift - for example - and have low enough tips that the combined total of tips and employer paycheck are below standard minimum wage the employer is required to top off their check with the difference. But the employer is permitted to assume a certain amount of tips and pay based on that unless the employee reports otherwise.
