Moreover, the article -- written by a London based reporter who isn't a lawyer and started out as a theater critic -- predated the superseding indictment, which added charges against Nauta and Oliveira, as well as Trump, for obstruction of justice, concealing documents in a federal investigation, etc -- all of which took place entirely in Florida. When the initial indictment was filed in June, Smith undoubtedly knew that he was likely to file the superseding indictment. So even if there was an argument -- the one that itself would be "hard" to make -- for bringing the case in DC, he would have found himself having to bring a second case in Florida to go after these other counts and splitting them up would be a strategically bad move.

There are any number of articles out there, written by actual criminal law practitioners, that explain why Smith was constrained by law and circumstances to bring the case in Florida.
