Had she not reversed her decision on making witness names public, Smith could have gone to the 11th for an appeal and demanded she be removed based on her long-running hostility and egregious decisions that the 11th has already had to overturn. She was probably advised she’d kinda fucked herself with the original decision and his appeal to her let her pull her own bacon out of the fire.
