4. Why would they?

If the cases were going forward before the election, there's no reason for them not to go forward after.

In fact, if we assume the silly "don't prosecute during an election year" claim has some validity, there would be more reason to pursue them afterwards as that would no longer be a factor. Personally, I always found it ridiculous.
