2. First time I've ever...well, I guess you can't say disagreed, but I think RP is missing something:

Almost every time Scalia has opened his mouth and said something we're offended by- at least in the last 3+ years, he's also including a dare to fix it.

I've written about this a couple of times and for all of you who believe Scalia is a bastard...well, you're right of course, but at the center of every little bastard thing he does he almost always goes out of his way to say "You don't like it? Get your congressman to enact laws which make it clear."

It's like he's a serial killer who sends threatening notes to the police which contain hints about how he can be caught.

His dig is that the legislative branch is almost completely broken. The Supreme Court is relied on more and more to interpret things which simply have no or little analog in The Constitution, yet the Legislative branch doesn't actually get off its ass and make legislation which would otherwise make his job easier.

So expect that Scalia, for the rest of his life on the bench, will continue to do outrageous things, make outrageous rulings.

He's taunting us and, AFAIK, legislators are never going to address the issue he loves twisting the knife about.
