2. Interpreting the constitution cynically, sure, there are several ways to authorize illegal activty

He can simply have the illegal activity not investigated or not prosecuted

He can have it prosecuted but settle for $1.

He can have it prosecuted and go to trial then botch it so double jeopardy protects to criminals.

He can pardon them.

All these would be contrary to the spirit of the constitution, which calls for the president to execute the laws in good faith, but if congress won't impeach and remove him for abuse, misuse, or neglect of office, he can get away with it.

And worse.
