(46,135 posts)Maxwell's petition for certiorari originally was due in January. At her request, Justice Sotomayor extended that deadline until April 10. The government's response was due May 14. It was extended until June 13 and then, without objection from Maxwell, extended again until July 14.
The headline on the original story was accurate. The person who tweeted about it got it wrong.
Also, she isn't seeking a new trial. She is arguing that she shouldn't have been prosecuted in the first place because of a plea deal. Specifically, the question she is raising for the Court consider is the following: "Under Santobello and common principles of contract interpretation, does a promise on behalf of the United States or the Government that is made by a United States Attorney in one district bind federal prosecutors in other districts?"
