7. Well, I'm not saying they are or are not fake, I lean towards them being real

BUT:
1) The regime controls ALL the evidence. The content of these messages is, very literally, whatever they say it is. If Tyler's lawyer (does he even have one of those?) says "that is made-up bullshit, that exchange didn't happen", how will they PROVE it did not happen? Proving that something did not happen is much harder than proving something did.
2) The right is rather famous for judge shopping
3) If the truly incriminating parts were real, but there was added fluff to concoct a storyline (things like "love" ), the incriminating parts, plus all the other evidence, is what's going to matter, esp. to the MAGA-friendly Trump-appointed judge they'll get.
4) They can pretty much say these texts are whatever the hell they want if they already know that there's never going to BE a trial, can they not? Plea deal, Ruby'd, Epstein'd (either theory on that event) ... all kinds of scenarios could lead to no trial.
5) Hell, even if it does happen, by that time, the way things are going? The regime will have declared an Enemy Combatant member of the notorious domestic terrorist group known as "Gay/Trans Antifa" and the trial will be at Gitmo.

I wouldn't hang my hat on the idea that this must be real "because the trial". I'd say the trial implications are a reason for pause, at best.
