(102,672 posts)The presidency has had that power for a very long time and it is a power afforded him in the Constitution. In fact, in case you weren't aware, EVERYTHING that happens with regard to laws concerning Native Americans can only be handled by way of three legal mechanisms afforded in the Constitution: An Act of Congress, a Judicial Decree from the SCOTUS or an Executive Order from the President, period. Executive Order is one of the "checks/balances" that exist to to by-pass a tyrannical Congress. Trust me, the current House has no interest in doing the Peoples' business as long as Obama is in office and in order for anything to be done, there will likely be a need for this on this particular issue. It's not like he's planning to go around and collect people's guns, that's a crock of poo generously served by the RW insanity faction, just look at them! And their mouthpieces like Flush Rimjob and his ilk... all fearmongering imbeciles with a microphone screaming fire in a crowded theater.
And how many times were there riots and sniper activity when W used and abused this power nearly every other week sending us to needless wars and taking our freedoms away? Do you know how many time Obama has used the EO in comparison to W?
