The purpose of the lawsuit is to change practices that are hurting people. to force preventative measures to make sure it doesn't happen again. There has to be a pattern of bad behavior by the defendant to get to court.
Perhaps in his world there is an insurance company, usually for private businesses. Public schools pay judgements out of the state treasury, and will muster its corral of attorneys to defend against it, right or wrong, to protect the treasury.
I've seen cases where a state AG begged the legislature to change their practices in regards to the vulnerable to stop having them defend what the AG said was wrong and illegal, but they had to defend.
Many entities are self-insured, it makes no sense to go through a middle man, that is, an insurance company. What is reported in the news is but the tip of the iceberg in such situations, to warn the defendant what is coming their way.
All the details are not put in the media. The world is not what RW media says it is.
