might there also be a political rationale?
I'm totally kidding by asking that question. The politics is so obvious. In my opinion, the politics overwhelms the legality. You don't have to agree with that, but if you think it's ALL about the law, and public safety and whatever, you are in denial, which is something that is not unheard of here.
