5. The most effective way to defend someone charged with rape is to intimidate the victim.

The legal defense in court must attack the credibility of the accuser. It all comes down to that. And juries tend to sympathize with the victim, so defense attorneys must attack the accuser's credibility very aggressively. Far more effective than any approach in court, though, is to scare off the accuser and get the charges dropped. Thus, gossip and rumors, trashing the reputation of the victim, threatening the victim with social repercussions, or worse, becomes a big part of the accused's legal defense.

The mystery is why other people fall for this. He obviously has tremendous motive to lie, trying to stay out of jail. She has much smaller motive to make a false accusation, and considerable motive to lie by staying silent.
