34. Self defense isn't about the injuries you have sustained.

It is about the injuries that you are in fear of sustaining.

As another poster put it, consider a man is swinging an axe at your head with the obvious intention of killing you. He misses his first swing. You have no injuries. By your standard, you can't shoot as you have no injuries. By the law, you can shoot because you are afraid that he will connect with his next swing.

That is the way self-defense law works. If you shoot someone because of injuries that you have already sustained, no matter how serious, then that is revenge and is illegal. You shoot because you are afraid of future injuries and don't want to sustain them.

Dr. Di Maio is not paid to lie. If he is ever caught lying then he would lose his ability to be an expert witness. He is paid to give his expert opinion on gunshot wounds.
