Isn't supposed to be about empathy.
Lets forget about this case for a minute Lets imagine you are out somewhere and someone shoves you and you shove them back, not intending to cause harm, but the person falls and hits his head on something hard and dies
Would you really want your case to be decided by a jury based on empathy for the victim?
Why even bother having a trial? Just let six or twelve people hear what you did and feel sorry for the victim. Automatic conviction on whatever charge they think is best based on how much they despise you.
That would work, right?
Probably not.
