working in tribal law, so I will have to ask him about the specifics of the Act, but my understanding of it is that it would certainly apply in this case and that any energy company will have a fight on its hands. Given the current Congress and Supreme Court, however, I wouldn't be surprised if a way was found around it for energy corporations.
