(110,255 posts)New York State for a long time has had insurance available to all that has NOT been mandated. Consequently, people have only joined it when they need expensive care, and the rates have gone up and up as the pool consists only of sicker and sicker people. The only way to lower the average rate is to bring healthy people into the pool. But since ANYONE could get in a car accident or develop cancer ANY TIME (they're deluded if they think otherwise), this is fair.
And you're wrong about there being nothing in the legislation that forces insurers to lower rates. There is a provision that requires insurers to pay at least 80% of premiums on actual health care, not administrative or marketing costs, and that has already resulted in some insurers having to pay rebates to their customers.
