This has been shown to be FALSE. It's not even in question at this point, despite no actual court case. My original point was that the NSA has had unlimited ability to violate the Fourth amendment. There needs to be absolute oversight or their programs and their protocols. To abdicate responsibility in that regard shows a fundamental lack of leadership.
