(4,462 posts)Any attorney (and I should know, I am one in NY and NJ) who would institute an action based on your reasoning would be incompetent, and likely face sanctions, particularly in federal court. In my career, I've both assisted clients with claims before the EEOC and related state and city agencies, and defended companies against charges, and even the very, very liberal employees of these agencies would tell you how they've heard the Fox news allegations for years, and ask if you had any real evidence of discrimination or a hostile work environment.
Although if the OP were disciplined by her employer, and she raised your defense, I would certainly like to see the bemused reaction of her boss and the company's counsel.
Simply, you cannot claim a hostile work environment solely because you have to listen to the daily programming of a cable news network, even Fox, and claims of racial or gender bias in the workplace are not a legal defense to vandalism and related charges.
I represented both women and minorities in real bias cases, and advice like yours will not effectively serve either of these groups.
