What the 43 did, actually, was give more of their own power away to the executive branch.

Their power has been so eroded that a congressional subpoena is laughed at. The January exemption has been established so that there are no congressional restraints on an illegal act from the executive. In addition, the 43 have proved that impeachment holds no power.
