1. "1st Amendment" & "free speech" are not magic code words

You can't just cite them as any reason to do anything you like.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

I don't see anything there that allows a company (Corporations are not people, my friend) to track a persons actions.
