5. There's a treaty protecting whales that Japan signed and ratified. Not so for sharks or dolphins.

The ICJ has jurisdiction in this case because Japan signed the International Convention for the Regulation of Whaling. There is no similar law for sharks, and Japan is has not signed or ratified the treaty on dolphins and isn't bound by it. There's little chance they will do so anytime soon.
