In almost all cases of murder the Feds have no standing whatsoever to do anything else. They CAN'T take the case away from the state, as they have no Federal crime to charge them with. The Hate Crimes law is one way in which they may be able to do so in this case, but they will have a difficult time making the case that this was incontrovertibly racially motivated.
It is very easy for us third party observers to believe that such a crime is racial, but the Feds have to prove that it is, which isn't all that easy to do.
