the constitution does not set a number or in theory prevent the practice but it won't work with the current make up. Too many conservative Democrats and even with those not so politically conservative there are a great many too process conservative. I bet the upper number who would go along is around twenty, super tops.

Too much fear of a giant hyper partisan court created by each party re balancing the deck and resistance to any dilution of power.

Prime probability outcome is a rebellion of the Democratic right wing combining with the corporate wing of the TeaPubliKlans to "restore order" and rein in "an out of control executive".

Also, the reality is Obama is beat down (or playing such on TV) and is appointing out right wingers for lower courts as is, giving great deference to Senators that is not required and has been ignored in the past and will be again when a TeaPubliKlan is pResident.
