Paul Kirk (D-MA) was appointed to fill the vacancy, he served from September 24, 2009 to February 4, 2010

Scott Brown (R-MA) took over Kennedy's seat February 4, 2010

Now, add up the time after Franken was sworn in and DEDUCT the one month that Kennedy's seat was vacant AND all of Congress recesses including Thanksgiving, Christmas, New Years, etc
and you'll find that there was a VERY SHORT period of time where the Dems had a 60 member filibuster-proof majority.

Edited to add: Also Kennedy was not able to be present at Congress the last couple of months of his life.
