Is it likely they were attacked for being perceived as gay? Sure.
But it takes more than just the victim saying it was because they are gay to make it a hate crime. Look at the actress recently who claimed she was detained because the cop thought she was a prostitute when she was kissing her boyfriend. It turned out she wasn't being entirely truthful. I'm not saying that's the case here, but in order for the police to press charges as a hate crime, they have to be able to make the case based on more than just the victim's say so. Otherwise how many Fox News viewers would claim if they got mugged by a black guy that it was a hate crime?
