9. While I see your point, given the times we live in,

a lot of people would view a cop with a gun as threat of force in combination with theft. More people then less would be in fear of their lives at the thought of the consequences of calling out the cop for this theft. I would not assume that the guy would not pull out his gun an develop some trumped up charges to cover his crime.
