38. No way any reasonable person could read it as anything but

Tangents aside, it takes one click through to the source article to see that the headline is in error - due diligence 101.

You don't even have to go that far to figure out that if someone is released, an arrest is a prerequisite for that. Complaining that someone who committed no crime wasn't arrested isn't a terribly good angle to pursue, anyway. No crime committed = innocent man = no grounds for arrest. Which is the exact same thing I hate to tell right-wing nuts over and over about Eric Garner, that "resisting arrest" is a bullshit reason to have used violence on him, when there was no justification to make an arrest in the first place.
