Beyond the discrimination,which is a big issue, Don't Ask, Don't tell, Don't investigate (many people forget about this third and last component) was plagued by vagueness and violated by the military itself on hundreds of occasions. The branches did in fact investigate outside the bounds of the policy, etc.

You are comparing a straightforward policy that does not discriminate to a discriminatory policy that was vague, arbitrarily applied and in many cases clearly violated by the armed forces.
