Dred Scott is a horrible relic of its time, and of course there's no way to justify it. These days, though, a stolen election ultimately did also cause many deaths as well as the almost complete destruction of an entire country. Elections obviously do have consequences, and stolen ones can cause horrific damage, exactly as the Court's appointment of Bush to the presidency did. So that's why I mentioned Bush v. Gore. Its consequences were disastrous, as are the ongoing consequences of Citizens United. I did not in any way intend to minimize the terrible consequences of Dred Scott, which some legal scholars do consider to be the worst Supreme Court decision ever, and which may have indirectly contributed to the Civil War.

For me it will always be Dred Scott. Bush v Gore just affirmed ineqaulity for this century.
