isn't something like a fitness club a private enterprise that can establish their own rules? And those rules can include what might otherwise be illegal discrimination? I'm thinking of the fact that a while back I belonged to a woman only fitness club. I don't know if there are any men only gyms, and I'm not sure if there are still any men only private social clubs, and perhaps my gender example isn't a very good one.

I do know that at least until relatively recently (and maybe still ongoing) there were golf courses that did not admit Jews and it was perfectly legal, if dumb and despicable.
