60. is it art ?

If a simple drawing that could be considered an expressionist art form can be labelled as hate speech/art etc simply because it depicts a group in what that group sees as blasphemous depictions, then would the 'cricifix in urine' or 'piss christ' be seen the same even though no catholics/christians went in and shot up the exhibit areas that art was displayed ? First amendment either works for all, or for none.
