(46,120 posts)There has been a law against the use of profanity in public on the books in Arlington for a long long long time. The penalty was $100. It was increased to $250 because that is the fine provided for in a state law against public use of profanity. But the law is almost never invoked, which is why your claim that this is about revenue generation is inaccurate. In 2014, Arlinton issud four citations for public profanity, two in situations where people were cursing in front of children and kept it up after the cops tried to get them to stop. Another one was for someone who also was charged with public drunkeness.
As for the change from "drunkeness" to "intoxication", that was done to make it clear that it covered being under the influence of illegal drugs as well as alcohol.
Notwithstanding all of the above, chances are that the law against public cursing is unconstitutional as written.
