Sometimes there's not. Not all hate crimes are prosecuted as hate crimes, or even readily identifiable as hate crimes. Not everything prosecuted as a hate crime is.

Most often "hate crime" is in the eye of the beholder, and the prosecutor's opinion may vary, as well as the judge's and jury's.

Imagine the races reversed, and people would be all over the hate-crime angle. "We're good, they're bad." It gets tedious.
